I. Basic Definitions
1. Simply-cash.com – an online classifieds service available at the domain simply-cash.com, acting as an advertising platform for posting and browsing advertisements.
2. User – a natural person at least 18 years of age with full legal capacity, a legal person, or an organisational unit without legal personality but capable of acquiring rights and incurring obligations on its own behalf, using Simply-cash.com.
3. Advertisement – a page/server space on Simply-cash.com provided to the User, containing data and photos posted by them in the form of an advert.
4. Account – a part of Simply-cash.com accessible to the User after providing a login and password, through which the User can perform specific actions within Simply-cash.com.
5. Administrator – the entity managing and developing Simply-cash.com, which is D-Link Dawid Zdeb, 24-220 Niedrzwica Kościelna, ul. Krakowska 56, Poland; providing Users with IT system resource sharing services, including the Simply-cash.com website, for the purpose of storing data in the form of adverts published on the site, under the terms specified in these Terms and Conditions and in accordance with relevant Polish law, in particular the Act of 18 July 2002 on the Provision of Electronic Services.
6. Terms and Conditions – these rules and regulations.
II. General Provisions
1. These Terms and Conditions define the rules for using Simply-cash.com, the rights and obligations of the User, as well as the rights, obligations, and scope of liability of the Administrator.
2. Upon accepting these Terms and Conditions, the User declares that they have read their content, agree to all terms, and undertake to comply with them.
3. The Administrator reserves the right to amend the Terms and Conditions. Amendments become effective on the date specified by the Administrator, but no sooner than 7 days from the date the information is posted on Simply-cash.com, provided that services activated before the amendment comes into force will be carried out under the existing rules.
III. General Terms of Use
1. To use the services provided by Simply-cash.com, a device communicating with the Internet and equipped with a web browser is required.
2. Logging in via Facebook to Simply-cash.com and posting the first Advertisement is equivalent to entering into an agreement between the User and the Administrator for the provision of services under the conditions provided in these Terms and Conditions.
3. A User logged in via Facebook on Simply-cash.com may add their adverts and is provided with access to their content for editing and deletion purposes.
4. The User is obliged to provide only true and current data.
5. The Administrator does not participate in transactions made between Users or in disputes arising between Users.
6. The conclusion and execution of transactions between Users, as well as all related payments, take place directly between the Users.
7. User contact details appearing in the advert may only be used by another User to establish contact for the purpose of conducting a transaction. Using them in any other way is strictly prohibited.
IV. Posting Advertisements
1. Posting advertisements on Simply-cash.com is free of charge.
2. Activation of a free advert occurs automatically after logging in via Facebook and adding the advert to the Simply-cash.com service.
3. Users may only use the Simply-cash.com service after logging in via Facebook.
4. Posting an advert requires acceptance of the Terms and Conditions and completion of the relevant form by the User.
5. By publishing an Advertisement and its content, including photos and a phone number, the User voluntarily makes them public and agrees to their disclosure to other Users, particularly those using the Internet. Adverts may also be indexed by search engines, of which the User is aware and to which the User consents.
6. The User agrees to link their adverts with the email address used when logging in via Facebook.
7. It is permitted to post only one advert concerning the same item/good/service, etc., regardless of the selected location or category.
8. It is prohibited to post adverts that:
- are misleading or manipulate keywords
- are inconsistent with the actual state of the advertised item/good/service
- contain content or photos generally considered offensive, vulgar, or violating the principles of good manners and etiquette
- contain photos showing deliberately obscured nudity, lewd or provocative poses, close-ups of breasts, buttocks, or groin
- violate ethical principles or the dignity of third parties
- contain addresses, names, or advertisements for other websites and online services
- contain a phone number, email address, or instant messenger ID in the title or main body of the advert
- contain content or personal data intended to violate the personal rights of third parties in any way
- show signs of unfair competition
- violate applicable laws or third-party rights
- promote and advertise other websites, in particular classifieds and auction sites
9. Regardless of the above, it is prohibited to offer:
- job offers without a job description, employer name, and specified place of work
- online job offers and remote work offers
- cottage industry (homeworking) offers, or job offers of an erotic nature
- direct marketing, financial pyramids, and other similar networks
- financial products and services such as credits, loans, policies, insurance, compensation, deposits, bank accounts
- stock market investment systems, number game systems, and bookmaking/betting systems
- affiliate and loyalty programmes and services related to such programmes
- items originating from theft, fencing, or other crimes
- erotic and pornographic materials
- prostitution, sex offers, erotic encounters, sexual services, sponsorship
- escort services, erotic services, intimate massage services, any erotic-themed photography services
- erotic gadgets and products
- pharmacological agents
- drugs and psychotropic substances
- cannabis, its seeds, and derivative products
- medicines and goods dangerous to human health and life
- alcohol, cigarettes, tobacco, and tobacco products
- the sale of dogs and cats without information allowing identification of the breeding source, organisation, and litter they come from
- weapons, ammunition, and pyrotechnic materials
- Master's, diploma, Bachelor's, or secondary school theses, essays, and services related to the creation of such works
- counterfeit (non-original) goods
- services, advertisements, and products related to love rituals, horoscopes, zodiac signs, love potions, spells, and parapsychology
V. Rules of Liability
1. The User bears full responsibility for the published content, including photos, and is obliged to ensure they do not violate applicable laws, these Terms and Conditions, third-party rights, the Administrator's rights, principles of social coexistence, or good customs.
2. The Administrator is not responsible for the behaviour and actions taken by Users on Simply-cash.com.
3. The Administrator is not responsible for the quality, condition, origin, or legality of the goods and services offered, the truthfulness and reliability of information provided by the User, or the ability of Users to complete a transaction.
4. The Administrator is not responsible for the non-performance or improper performance by parties of agreements related to the Advertisement, nor for damages resulting from such an agreement.
5. The Administrator is not responsible for the lack of interest in an Advertisement.
6. The Administrator reserves the right to remove an advert, change its category, or appropriately edit published content (including photos) that:
- violates these Terms and Conditions
- violates applicable laws or third-party rights
- is generally considered offensive
- is placed in the wrong category or location
7. The Administrator reserves the right to fully or partially block a User's access to Simply-cash.com in the event of repeated violations of applicable laws or these Terms and Conditions.
8. The Administrator reserves the right to remove an advert or block a User's access to Simply-cash.com if there is a suspicion that actions threatening the safety of other Users have occurred or may occur through Simply-cash.com.
VI. Complaints and Withdrawal from the Agreement
1. Complaints regarding the provision of services referred to in these Terms and Conditions may be submitted via email to pp@simply-cash.com, through the contact form, or in the form of a registered letter sent to the Administrator's address.
2. A complaint should include the identity of the person making the complaint (name, surname, correspondence address, email address) and a description of the event causing the complaint.
3. Complaints will be considered within 14 days from the date of submission.
4. Withdrawal from the agreement is possible without giving a reason within 14 days of its conclusion.
5. Any disputes related to services provided within Simply-cash.com will be resolved by the competent Polish common courts. A User who is subject to consumer protection has the option to use out-of-court methods for resolving complaints and pursuing claims.
