I. Basic Definitions
1. Simply-cash.com – An online classifieds website available at the domain simply-cash.com, acting as an advertising platform for posting and browsing listings.
2. User – Any natural person at least 18 years of age with full legal capacity, a legal entity, or an organizational unit without legal personality but capable of acquiring rights and incurring obligations on its own behalf, using Simply-cash.com.
3. Listing – The page/server space on Simply-cash.com provided to the User, containing data and photos posted by the User in the form of an advertisement.
4. Account – The section of Simply-cash.com accessible to the User after entering a login and password, through which the User can perform specific actions within Simply-cash.com.
5. Administrator – The entity managing and developing Simply-cash.com, which is D-Link Dawid Zdeb, 24-220 Niedrzwica Kościelna, ul. Krakowska 56, Poland. The Administrator provides Users with IT system resource sharing services, including the Simply-cash.com website, for the purpose of storing data in the form of listings published on the site, under the terms specified in these Terms of Service and in accordance with applicable Polish law, specifically the Act of July 18, 2002, on the Provision of Electronic Services.
6. Terms of Service – This document outlining the rules and regulations of the website.
II. General Provisions
1. These Terms of Service define the rules for using Simply-cash.com, the rights and obligations of the User, as well as the rights, obligations, and scope of liability of the Administrator.
2. By accepting these Terms of Service, the User declares that they have read the content, agree to all terms, and commit to complying with them.
3. The Administrator reserves the right to amend the Terms of Service. Amendments become effective on the date specified by the Administrator, but no sooner than 7 days from the date the notice is posted on Simply-cash.com, provided that services activated before the amendment takes effect will be governed by the previous rules.
III. General Terms of Use
1. To use the services provided by Simply-cash.com, a device connected to the Internet and equipped with a web browser is required.
2. Logging in via Facebook to Simply-cash.com and posting the first Listing constitutes a binding agreement between the User and the Administrator for the provision of services under the conditions provided in these Terms of Service.
3. A User logged in via Facebook on Simply-cash.com may add listings and is provided with access to manage, edit, or delete them.
4. The User is required to provide only true and current information.
5. The Administrator does not participate in transactions between Users or in any disputes arising between Users.
6. The conclusion and execution of transactions between Users, including all related payments, occur directly between the Users.
7. User contact information shown in a listing may only be used by other Users to establish contact for the purpose of completing a transaction. Using this information for any other purpose is strictly prohibited.
IV. Posting Listings
1. Posting listings on Simply-cash.com is free of charge.
2. Activation of a free listing occurs automatically after logging in via Facebook and submitting the listing to the Simply-cash.com platform.
3. Users may only use the Simply-cash.com service after logging in via Facebook.
4. Posting a listing requires acceptance of the Terms of Service and completion of the relevant submission form.
5. By publishing a Listing and its content (including photos and phone numbers), the User voluntarily makes this information public and agrees to its disclosure to other Users and the general public on the Internet. Listings may be indexed by search engines, which the User acknowledges and consents to.
6. The User agrees to link their listings with the email address used during the Facebook login process.
7. It is permitted to post only one listing for the same item, good, or service, regardless of the selected location or category.
8. It is prohibited to post listings that:
- Are misleading or involve keyword manipulation
- Are inconsistent with the actual condition of the advertised item/service
- Contain content or photos considered offensive, vulgar, or violating community standards and etiquette
- Contain photos showing nudity, lewd or provocative poses, or sexually explicit close-ups
- Violate ethical principles or the dignity of third parties
- Contain links, names, or advertisements for competing websites or online services
- Include phone numbers, email addresses, or messenger IDs in the title or main body of the listing (dedicated fields should be used instead)
- Violate the personal rights of third parties or involve identity theft
- Constitute unfair competition
- Violate applicable laws or third-party intellectual property rights
- Promote other classifieds or auction websites
9. Additionally, the following are strictly prohibited:
- Job offers without a job description, employer name, or specific location
- Online or remote work offers that lack transparency
- Multi-level marketing (MLM), pyramid schemes, or "get rich quick" programs
- Financial products such as loans, insurance, or investment schemes
- Gambling systems, betting tips, or bookmaking services
- Items originating from theft or illegal activity
- Erotic or pornographic materials and services
- Escort services, intimate massages, or erotic photography
- Pharmacological agents, drugs, and controlled substances
- Cannabis, seeds, and related derivatives
- Alcohol, tobacco, and nicotine products
- Sale of pets without proper breeding documentation and identification
- Weapons, ammunition, and explosives
- Academic papers, theses, or essay-writing services
- Counterfeit or non-original goods
- Occult services, love spells, or parapsychology
V. Liability and Disclaimers
1. The User bears sole responsibility for all published content and photos and must ensure they do not violate any laws, these Terms, or third-party rights.
2. The Administrator is not liable for the conduct or actions of Users on Simply-cash.com.
3. The Administrator does not guarantee the quality, safety, or legality of the items or services advertised, the truthfulness of the listings, or the ability of Users to complete a transaction.
4. The Administrator is not a party to any agreement between Users and is not liable for any damages resulting from such agreements.
5. The Administrator reserves the right to remove or edit any listing that violates these Terms, is placed in the wrong category, or is considered offensive.
6. The Administrator reserves the right to block a User's access to Simply-cash.com for repeated violations or for security reasons.
VI. Complaints and Withdrawal
1. Complaints regarding the services may be submitted via email to pp@simply-cash.com or via the contact form.
2. Complaints will be reviewed within 14 days of submission.
3. Users may withdraw from the service agreement within 14 days of account creation without providing a reason.
4. Any disputes will be resolved by the competent courts in Poland. Users recognized as consumers may also utilize out-of-court dispute resolution methods.
